Resolving Alimony/Spousal Support Disputes

Spousal support, often called spousal maintenance or alimony, can become one of the most contentious factors in a divorce. While some marriages simply end, it is not uncommon for divorcing couples to harbor ill will toward each other. It can be challenging to reach an agreement through such strong feelings of animosity, but our Portland alimony attorneys have the experience to find a compromise.

At Berman Law Center, P.C., we understand that the notion of paying money to an ex-spouse can lead to negative feelings. It is our goal to mediate a successful compromise in the most efficient manner possible. If a compromise cannot be reached, we are fully prepared to defend your best interests through courtroom litigation.

Understanding The Different Types Of Support

While the determination of alimony is not fault-based, numerous factors must be addressed. Additionally, there are three types of support:

  • Transitional support: This support is designed to help one party re-enter the job market typically through the completion of schooling or additional vocational training. Transitional support generally has a shorter duration.
  • Compensatory support: As the title suggests, this type of support is designed to reimburse a spouse who has made significant financial contributions or sacrificed other resources throughout the marriage to the education, training or career of the other spouse.
  • Maintenance support: This is support designed to lessen a wide disparity in the earning capacity of the two parties. In these situations, it is determined that the less financially independent spouse is not likely to achieve a standard of living to which he or she is accustomed without the support of the other spouse. Maintenance support can last for a specific duration or it can be indefinite.
